An Introduction to Asset Protection - How to Shield Assets - An Introduction

Asset Protection refers to a group of legal techniques that protect a person's property from creditors and judgments. While there have always been protective measures available to persons to safeguard their assets, there has never been as great an interest in asset protection until recent years. The litigation explosion of the latter part of the last century prompted overwhelming interest in the property protection area.

The statistics are overwhelming: Nearly every American business and every US individual will be sued at some point in their life. An even greater number will be threatened with lawsuits. Despite these dismal statistics, only a slim percentage of Americans bother with any property protection considerations at all. Asset protection preparation ranges from simple tool s such as transferring assets to a retirement account, to more complex arrangements such as offshore trusts. In 1997, a judgment entered against celebrity O.J. Simpson in the amount of roughly $33,500,000 in a civil case brought by the family of his former spouse and the family of Ron Goldman following their alleged murders by OJ.

One might think Mr. Simpson's assets would have to be relinquished to satisfy this enormous judgment. Yet OJ lives in a lavish Florida home, and enjoys a robust pension. Sure, some assets have been seized, but the bulk of OJ's property remains out of reach of his creditors. In fact, Simpson has never declared bankruptcy or taken other action to extinguish the liability.
How is this possible? The answer is that OJ arranged his financial affairs in a completely legal manner that left his assets out of the reach of creditors. Florida, his adopted home state, just so happens to be one of the most advantageous states for property protection. When asked about his choice of domicile, Simpson responded in an interview that while he intended to move to Florida anyway, 'an added benefit is some of the laws here in Florida.'

Asset Protection planning can be effected in basically three ways. The first is divestiture, by which an individual transfers his holdings to another, either by outright transfer or by having liens or mortgages placed upon the asset. This method relies on the simple truth that a creditor cannot have what a debtor does not possess. The second way is through exemption planning, where an individual transfers assets to a statutorily protected class of assets, such as residential homestead, life insurance, or an IRA . These classes of protected holdings vary widely by state. The third way is through the use of liability shielding entities such as corporations and LLCs. Hiding one's assets is not part of responsible or effective property Protection planning. First, it may be against the law, and second, it doesn't work well.

Themes in property Protection

Several general themes apply in property protection:

*No asset protection plan can ever give anyone absolute protection from creditors; asset protection preparation can only safeguard most of a person's assets from creditors. Some property will always be exposed.

*The proper goal of an asset protection plan is to frustrate creditors and their lawyers by changing the creditor's economic analysis of a lawsuit (by making it more expensive and uncertain for the creditor). In other words, the plan itself doesn't give the protection; how a creditor perceives the plan gives the protection.

*Timing is important. An asset protection plan must be put in place well before a creditor or plaintiff emerges. Otherwise, the plan will be exposed as a transparent last-minute effort to thwart creditors.

*An useful property protection plan can be made even more useful by 'layering' different legal protections over the same assets.

* Compartmentalization is an potent asset Protection preparation tool. For example, an owner of rental properties (rental properties generally carry a high risk of liability) can place each separate leased property in a separate LLC or corporation. If one rental results in liability, a creditor will be forced to pursue liability against only one entity, and will not reach either the owner or her other properties.

*A simple property protection plan is generally more potent than a complex plan.

How Plaintiffs Operate

The key to property protection is to step into the mind of the plaintiff . First of all, the creditor can't just go around taking a debtor's assets until the underlying dispute is heard in court. Only after winning the suit can the plaintiff proceed to the collection phase of his suit. The creditor wants a quick, inexpensive trial. After that, the plaintiff wants a quick, inexpensive, and productive collection phase. Lawsuits are economic events and require economic analysis. Only a foolish creditor would pursue a case without some certainty of recovery. property protection seeks to deter lawsuits by confounding the certainty of a creditor 's recovery.

Safeguarding the Family Home: Homestead and Liens

For most Americans, the most valuable property they own is their personal residence. The residence offers some of the simplest and most potent asset Protection planning device s. In the event of a forced sale of the residence, the ousted creditors would receive the homestead exemption in cash. Homestead Protection is afforded automatically in most states, but it's always a good idea to file appropriate papers to claim the homestead. In states with low homestead protection, mortgages and liens provide a very effective means of protecting the personal residence. This process is sometimes referred to as 'equity stripping.' A residence with liens on it is essentially owned by the bank. The home's lienholders have priority over subsequent creditors. Any creditors who levy a home with one or more existing liens take a disadvantaged position behind the lienholders. In the event of a sale, the creditor is less likely to get a recovery. A assets owner can lien up his or her own holdings by increasing the size of an existing mortgage, or by getting a home equity line of credit (HELOC). Most HELOC loans do not require the assets owner to ever draw money on the loan, drawing on the HELOC is optional but once the HELOC is in place, it discourages later creditors from pursuing the owner. A bankruptcy court is a de facto creditor, so a bankruptcy court can only reach what a creditor can reach. This principle applies to homestead laws as well, except for some recent erosion built into the 2005 bankruptcy law revisions. So, good asset Protection preparation is also potent pre-bankruptcy preparation. So, the holdings exemptions are plainly valuable.

Again, assets exemptions differ greatly by state. Texas places the full amount of all Individual Retirement Account s beyond the reach of creditors, while California exempts retirement accounts 'only to the extent necessary to provide for the support of the judgment debtor when the judgment debtor retires and for the support of the spouse and dependents of the judgment debtor.' California's subjective test for retirement account exemption results in frequent disputes. Florida exempts an automobile of up to only $1,000 in value, while Texas exempts one car of unlimited value per spouse. Florida and Texas exempt wages from garnishment, which most states do not. The property exemptions also contain some historical oddities. Texas' generous property exemptions include 'two horses, mules, or donkeys and a saddle, blanket, and bridle for each; 12 head of cattle; 60 head of other types of livestock; and 120 fowl.' In order to take advantage of the holdings exemptions, one must first investigate the assets exemption laws in one's state of residence this state's holdings exemption laws will govern. assets exemption planning is simply the process of transferring non-exempt holdings into exempt holdings. The simplest and most common example is to arrange and select the most appropriate retirement account. Moving cash into an IRA in most states will protect the asset from creditors. There have been cases where uniformed debtors cashed out their pensions (pensions are fully asset safeguarded by federal law) and moved the proceeds into non-exempt assets, thereby exposing the property to creditors.

Nearly every business owner can protect their personal assets by conducting their business operations through a liability shielding entity, a corporation or LLC. Both forms of entity serve the same indebtedness shielding purpose. LLCs and corporations serve the specific purpose of isolating the liabilities of a business enterprise with the entity. A debt arising out of the corporation's operation attaches to the corporation only, and cannot reach the owner's or owners' assets. The Ultimate Cure For Helmet Hair!

There is no doubt about it, wearing a helmet is one of the most important safety features when it comes to riding a motorcycle. Indeed, and it does not matter if you are the one revving the engine, or act as sexy back-seat fender fluff, protection is of the utmost importance to all. Even so, when it comes to helmets, they are not very attractive and often come with another unpopular feature, a trait that has turned many ladies away from participating in this exciting pass-time. Undeniable but true, helmet hair is one of the most unappealing attributes bikers have to deal with, and even though men tend to see it as less of a problem, it affects both genders.

Unfortunately for you guys out there, today I am addressing only my own dilemma, and will try to find ways that will help me keep up my appearances, even after I remove my helmet. As a newcomer to this thrilling hobby, which I have enjoyed so far, I would like to discuss my own possible hair-do options, which do not include shaving my head, even if it sounds easy and convenient. Believe me, a crew-cut does not appeal to my femininity!

The rule I was told, when checking out the bike shop, stated that my helmet was supposed to sit snug on my head and leave no room for movement. This would enhance skull protection if it would ever hit the pavement. Worried about my noggin, and following those strict guidelines, I soon found out that, with my head barely fitting into this fiberglass capsule, there absolutely was no room for a baseball cap, scarf, bands or ribbons. So, what was I supposed to do now, other than pack a wig in the trunk?

Shortly before my virgin ride I frantically searched my dresser drawers and found a smaller scarf I once received as a Christmas gift. I hid it in my jeans back pocket and off we went. As soon as the ride was over and my helmet came off, I tied the scarf around my head, pulling my shoulder-length hair back behind my ears. A quick look in the bike's mirrors showed me I was good to go. There was no hair wetting, spit or sticky gel involved and it was almost perfect. The only thing missing were a few hair clips, which could have kept the material better in place.

My husband and I decided to join a biker's club and our first outing with them was going to be a scenic night ride, ending with a dinner at a restaurant. I checked out the place online, and even though it did not come across as a five star diner, I still wanted to look my best. Armed with my 40% discount coupon I hit the craft shop and bought a ball of fancy, cotton-based, glittery yarn and enthusiastically crocheted myself a nice head band. With a fine black border it would fit with any jeans outfit I had in my closet and, as an added bonus, was easy to store - even with two bobby pins attached to the side. Actually, it worked out so well I want to go back to the market and buy different shades of thread as soon as I can get my hands on more discount vouchers.

Reinforced by my intuition I knew deep down that there just had to be something else out there that would do us backseat mamas proud, but what? Baseball caps were not quite my style, and even though I feel attracted to hats, I only own one. I adore them, yet cannot find any standard North American sizes that will fit my European, undersized head.

While rummaging through some mixed sales bins the other week, I came across a gadget that piqued my interest as soon as it came in view. In my hand I was holding an invention I had never seen before, and believe it or not, it happened to be a master-piece! Actually, it was a rechargeable curling iron, one that even came with a fancy travel pouch. The price was right, and even though I usually am not much of a gambler, or an extravagant spender, this item made it into my shopping basket. As soon as I arrived back at the good old homestead I charged up my new friend and later that day tried it out. Amazed at the results I knew I had found a great solution to my helmet hair problem, and even if I do not intend to pack it on short pleasure trips, I will certainly hold it tight whenever we drive in club formation, up to another fancy dining hall.

Myrtles Plantation: The Most Haunted Plantation in Louisiana

The infamous Myrtles Plantation in Louisiana is widely considered one of the most haunted places in America. Located on 650 acres of land in St. Francisville, La. The homestead was built in 1796 by General David Bradford. What the general, along with several other future owners did not know was that before the land had been seized by the Spanish, it belonged to a local Indian tribe known as the 'Tunicas'. These native American peoples used the land as sacred burial grounds. As any ghost hunter or supernatural historian will tell you, this type of sacrilege is a breeding ground for supernatural activity, and not usually friendly activity at that, as the spirits of the dead are never happy about being rudely disturbed.

Some years down the road, one of David Bradford's law students and family friend, Clark Woodruff married Bradford's 14 year-old daughter, Sarah Matilda. Woodruff was a mature 35 but arrangements like this were pretty common back then. Together the couple had three daughters, Cornelia Gale, Jane, and Mary Octavia. In 1808, after Bradfords death, Clark and Sarah moved their family into the Myrtles home. As was the custom back then, the well-to-do in the south owned slaves. Some worked in the fields and others were house servants. One of these house servants was a young woman named Chloe. Chloe had particularly close ties to the family, as she did the cooking and took care of the Woodruff's daughters personally. It is believed that she and Clark were having an affair. Whether Sarah Wood ruff knew about this, is unknown.

Now Chloe, who had such close-knit intermingling with the Woodruff's, had the opportunity to over hear certain goings on around the homestead. Most times she would eavesdrop to find out what was going on with her fellow slaves. Things like, if there were new slaves being brought onto the property, or which slaves were to be sold or traded to another owner. But lately, Chloe was eavesdropping to find out about what was going to be happening to her. You see, as of late, she had started to suspect Mr. Clark was becoming tired of her. She figured he'd send her to the fields, rather than take a chance on her saying something to Sarah Woodruff about their torrid tryst. However, one day Chloe got caught. Her punishment was cruel. For the offence of eavesdropping, one of her ears were cut off.

Fearing she would certainly be sent out into the fields now, Chloe hatched a plan to save her current status. She gathered some leaves from an Oleander plant and boiled them in water. This would create an arsenic-like liquid she planned to pour in the batter for a birthday cake she was making for one of children. It is widely believed that her intention was not murder, but instead just to make the girls and their mother sick, so she could nurse them all back to health. This would make the family grateful to her and she would be able to remain on as the family's personal servant. But Chloe's plan went horribly wrong. She had underestimated the strength of the poisonous mixture and within a couple of hours of eating the cake, two of the girls and Sarah were dead. Chloe confessed what she had done. Then, as revenge for the two little girls, an angry mob of both black and white men and women took her and hung her from a tree on the location grounds. Woodruff stayed on until 1834, Then he sold the property and moved to New Orleans. He died in 1851.

These days the Myrtles plantation has been restored and now functions as a Bed & Breakfast. Many guests of the home claim to have seen ghosts and heard sounds, such as footsteps. The ghost have been identified as the Woodruff daughters, Cornelia Gale and Jane, along with their mother, Sarah Matilda, and house servant, Chloe has also been spotted. The girls have been seen playing about the house, (usually upstairs), and on the grounds. Sarah Matilda's ghost is seen mostly on the main staircase, walking down it as if to greet guest as they arrive. Chloe is often seen wandering about the grounds and has been seen by the tree where she was hung from.
